These Terms of Service ("Terms") constitute a legally binding agreement between you and True Anchor LLC ("Company," "we," "us," or "our") governing your use of the Apex Browser service, website, and related tools (collectively, the "Service").
By accessing or using the Service — including by creating an Administrator account or creating a child profile — you confirm that:
Apex Browser is a parental-controlled web browsing environment designed to provide children and teenagers with a focused, safe browsing experience for educational use. The Service includes:
The Service is provided as a software-as-a-service (SaaS) product accessible via web browser at apexbrowser.app. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
Administrator Accounts: You must be at least 18 years old to create an Administrator account. By creating an account, you represent that you are 18 or older and are the parent, guardian, or authorized caretaker of any children whose profiles you create.
Child Profiles: Child profiles may be created for minors of any age. Child profiles are not independent accounts — they are sub-profiles of the Administrator account and are controlled entirely by the Administrator. Children do not have their own login credentials and do not enter into any agreement with True Anchor LLC.
School or Institutional Use: If you are using Apex Browser on behalf of a school, tutoring organization, or other institution, you represent that you are authorized to bind that organization to these Terms. Institutional Administrators are responsible for ensuring that use of the Service complies with all applicable laws and institutional policies in their jurisdiction.
We reserve the right to terminate any account where we have reason to believe the account holder does not meet the eligibility requirements above.
As the Administrator account holder, you are solely responsible for:
You agree that Apex Browser is a supplementary tool to assist parental oversight — not a complete parental control solution. Determined users may find technical workarounds. You accept responsibility for monitoring your child's internet use beyond the controls this Service provides.
You agree not to use the Service for any of the following purposes:
The Chrome extension included with Apex Browser is provided as an optional tool to enhance the browsing control experience on compatible devices. We make no guarantee that the extension will function as expected across all Chrome versions, device configurations, or managed environments. Extension functionality is subject to Chrome's platform policies and may change without notice.
Free access: Apex Browser may offer a free tier with limited features. Feature availability by tier is described on our pricing page.
Paid subscriptions: Paid plans are billed in advance on a monthly or annual basis. By subscribing, you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel.
Cancellations: You may cancel your subscription at any time from your account settings. Upon cancellation, your paid access continues until the end of the current billing period. We do not provide prorated refunds for partial billing periods.
Refunds: We will provide a full refund within 14 days of the initial purchase if you are not satisfied with the Service. After 14 days, we do not issue refunds except as required by applicable law.
Price changes: We may change subscription prices with 30 days' notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new price.
Payment processing: Payment processing is handled by a third-party processor. We do not store your payment card information.
Our intellectual property: The Apex Browser name, logo, design, software, and all content we create are the property of True Anchor LLC. You may not copy, reproduce, distribute, or create derivative works from our intellectual property without written permission.
Your content: Documents created in the Writer feature, designs created in the Design feature, and messages sent in the Chat feature remain your property. By using the Service, you grant True Anchor LLC a limited license to store and display this content solely for the purpose of operating the Service for you.
Feedback: If you provide us with suggestions or feedback about the Service, you grant us a royalty-free license to use that feedback to improve the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, True Anchor LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
Important: Apex Browser is a technical aid to parental oversight. It is not a complete substitute for active parental supervision. No internet filtering or parental control product can guarantee that children will never access inappropriate content.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: In no event shall True Anchor LLC, its members, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages resulting from a child's access to inappropriate content despite use of the Service.
True Anchor LLC's total cumulative liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the total amount you paid to True Anchor LLC in the twelve months preceding the claim, or (b) one hundred dollars ($100.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless True Anchor LLC and its members, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or relating to:
By you: You may terminate your account at any time by contacting us at hello@apexbrowser.app. Upon termination, all associated child profiles and data will be permanently deleted within 30 days.
By us: We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or if continued operation of your account creates legal risk for the Company or harm to other users.
Effect of termination: Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections 7, 8, 9, 10, and 12.
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict-of-law provisions.
Informal resolution: Before filing any legal claim, you agree to contact us at hello@apexbrowser.app to attempt to resolve the dispute informally. We will make a good-faith effort to resolve any complaint within 30 days.
Jurisdiction: Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Michigan, and you consent to personal jurisdiction in those courts.
Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class or representative action.
We may update these Terms from time to time. We will notify you of material changes by:
Changes take effect 30 days after notice is provided. Continued use of the Service after the effective date of revised Terms constitutes your acceptance. If you do not agree with revised Terms, you must stop using the Service and cancel your account before the effective date.
